Welcome to Focus Engine. These Terms of Use govern your access to and use of the Focus Engine web application, mobile PWA, local synchronizers, and associated digital services. By creating an account or subscribing to our services, you agree to comply with and be bound by these Terms.
1. Account Creation and Security
To access certain workspaces (including cross-device note synchronization and premium soundscapes), you must register an account using a valid email address. You are solely responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized use or security breaches.
We reserve the right to suspend or terminate accounts that violate security compliance or use temporary/disposable emails to bypass plan limitations.
2. Subscriptions and Payments
Focus Engine offers a Free plan and a Premium subscription tier ($5.00/month or $50.00/year).
- Subscription Billing: Premium subscriptions are billed in advance on a recurring monthly or yearly cycle.
- Payment Methods: Payments are processed securely via third-party providers (Stripe, PayPal, or Wise). Focus Engine does not collect or store your payment card credentials.
- Automatic Renewal: Recurring subscriptions renew automatically unless cancelled prior to the end of the billing period. You can cancel your subscription at any time within your billing portal.
3. Data Ownership and Local Storage
Focus Engine prioritizes data privacy and local ownership:
- Your Content: You retain full copyright and ownership of all text, documents, notes, folders, and configurations created inside the app.
- Local-First Storage: By default, notes and habits data are stored on your local browser (Local Storage/IndexedDB). Synchronizing with our cloud database is optional and intended solely for cross-device access.
- Data Deletion: You can purge your local storage or delete your cloud account at any time, which permanently removes all sync copies from our servers.
4. Acceptable Use and Restrictions
You agree not to use Focus Engine for any unlawful purposes. Under these terms, you are prohibited from:
- Attempting to bypass pricing tiers, API limits, or subscription checks.
- Using web scrapers, bots, or reverse-engineering tools to clone or copy application logic.
- Uploading malware, malicious code, or illegal content via note sharing or public attachment links.
- Disrupting server operations, causing Denial of Service (DoS) attacks, or intercepting API data transfers.
5. Disclaimer of Warranties
Disclaimer: Focus Engine is provided "as is" and "as available" without any warranties of any kind, either express or implied. While we strive to maintain 99.9% database availability and safeguard synchronized notes, we do not guarantee that your files will be free from local browser deletion due to system cleanups, or that cloud sync will never experience service interruptions.
6. Limitation of Liability
To the maximum extent permitted by law, Focus Engine and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data loss, or system downtime arising out of your use of the application.
